What Happens if You Don't Like Your Probation Officer?
You were arrested in Orange, Osceola, Seminole, Lake or Brevard County and pled no contest to a criminal charge. As part of your sentence you were placed on probation with the Department of Corrections or the county. The judge orders you to appear for your first meeting with your probation officer. You show up on time, fill out an information sheet and then wait to meet your newly assigned probation officer. Much to your surprise your probation officer is very angry at you and you know no matter what you do over the next two years on probation, you're not going to get along with your assigned probation officer.
What Should You Do?
The answer is very simple. Be very careful and protect yourself by reducing every communication to your probation officer in writing via fax or email and making sure you avoid in every way possible upsetting your probation officer.
The probation officer has tremendous power over you. If you commit a technical or minor violation of probation the probation officer may utilize his or her discretion and not violate your probation. On the other hand, if the probation officer dislikes you that probation officer may utilize his or her discretion and draw up an affidavit of violation of probation and ask the judge to sign a warrant for your arrest.
Therefore, should you have a personality conflict with your probation officer recognize the precarious situation you're in and:
- Get all of your conditions done in a timely manner
- Be respectful of your probation officer
- Communicate with your probation officer in writing, making sure you keep a copy of all of your correspondence
- Under no circumstances lose your temper with your probation officer
